Military Tribunal for Terrorism

The United States Supreme Court of Justice has given the Bush Administration limited power on trying ‘enemy combatants’ who are currently being detained at the infamous military imprisonment base, Gitmo.

“The military commission at issue is not expressly authorized by any congressional act,” said Justice John Paul Stevens, writing for the majority. The tribunals, he said, “must be understood to incorporate at least the barest of those trial protections that have been recognized by customary international law.”

The United States of America withdrew their commitments to the International Court of Justice in 1986 after violating international law against Nicaragua. Therefore the US reserves to place ‘enemy combatants’ on trial for crimes against their nation unjustly due to the circumstances that they will not be treated to a fair trial therefore should be placed on trial at the ICJ. Though, there has to be revisions on both sides since none have clauses to try terrorists.
